The lawyer is required to perform many tasks for you as his / her client.  Outlined below is a fairly intensive listing of what those tasks are.  While this is a very specific list, it is always prudent to ask your lawyer exactly what he or she does for you and for what fee.

It is best to get this information up front before you proceed.  While there should not be a problem it is wise to use a lawyer different from the seller, unless this isn't possible due to location or financial considerations (the lawyer's fees).

It is also best if you shop around.  Call three lawyers for quotes.  You might be surprised by the difference in price and service.

Lawyer's tasks can include the following:

  • To examine your Offer of Purchase & Sale
  • To examine title within the timeframe outlined in the Agreement of Purchase & Sale
  • To search to ensure that the property has good and equitable title
  • To examine Condo documents within the timeframe outlined if the property is a condo and not freehold
  • To examine the survey for any potential problems
  • If the seller is giving back a mortgage to the buyer (VTB), the lawyer will draft the mortgage documents
  • If the buyer is assuming a mortgage, the lawyer will examine the situation and advise if there are any potential concerns.
  • Request a draft Deal
  • Review the Statement of Adjustments to ensure everything is covered off...so there will be no surprises
  • If Letters of Requisition are requested, the lawyer will send them out
  • Prepare the Tax Certificate
  • All closing funds will be collected by the lawyer, usually 2 days before closing.  It is wise to check with your lawyer to find out exactly when he / she will want your funds
  • To ensure the closing is concluded at the Land Registry Office on the day of closing
  • The lawyer's office will forward ALL paperwork to you as soon after closing as possible
