There are true advantages to working with a signed Buyer Representation Agreement. Below is outlined the timing and the advantages to this agreement at these various stages of the buying process.

DURING THE QUALIFICATION PROCESS

  • The Buyer should feel secure in divulging information without the fear of harming their negotiating position.
  • The Sales Representative is obligated to pay full attention to all of the Buyer's needs.  This can include information on financial matters, timing, motivation, family needs, etc.

DURING THE HOME SELECTION PROCESS

  • It is the responsibility of the Sales Represenative to ensure that the Buyer has access to the entire market.  This includes private sales, MLS properties and possible exclusive listings.
  • The Buyer should know that he/she will have immediate access to new properties as they become available...as their Representative will be watching for new appropriate properties.

DURING THE HOME SHOWING PROCESS

  • The Sales Representative is obligated to assist the Buyer in making an objective comparison of all competing properties, comprehensive enough for the Buyer to make an informed decision as to the value of the property in question and to make an offer accordingly.

DURING THE NEGOTIATING PROCESS

  • The Sales Representative is obligated to present all sales statistics in order for the Buyer to make the most informed pricing decision...not necessarily in line with the sometimes overstated listing price.
  • The Sales Representative is obligated to provide input on protective clauses for the Buyer.  These could be on financing, home inspection, insurance and a myriad of other options.
  • The Sales Representative is available to offer assistance in procuring financing.  Most Buyers will opt to find their own source of funds; however, a Sales Representative will have options if needed.
  • The Sales Representative is obligated to provide negotiating strategies and techniques that are in the best interest of the Buyer.
  • Knowledge of any personal information about the seller must be shared with the Buyer...including any information on the price the Seller is willing to accept or anything relative to their motivation.

The Keys to Buyer Representation are Dedication, Confidentiality and Service.

I would never suggest that a Buyer enter into a written Buyer Representation Agreement unless he /she feels comfortable with the Sales Representative / Broker.  You will be spending a good deal of time together and you need to be at ease with the person that will be assisting you to find your next home...remember, other than finding the person you will share your life with...buying a home is the single biggest investment you will make.
